These Terms and Conditions of Use (“Terms of Use”) govern your access to and use of the NutriWiz application (“NutriWiz”), owned by Samuel Santos and Caio Pedroso, headquartered in Conchal, Brazil. By accessing or using NutriWiz, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the application.

1.1 Definitions:
The following definitions apply throughout these Terms of Use:
ACCOUNT CREATION
2.1. Creating an Account:
To create an account on NutriWiz, users must use a Google account. During account creation, personal information such as name, gender, age, weight, goals, and other relevant details are collected and stored in NutriWiz’s database to deliver personalized diet plans.
2.2. Data Sharing:
Personal data may be shared with third parties as necessary to provide the Services.
USE OF SERVICES
3.1. Subscription Requirement:
NutriWiz requires an active subscription for usage. If a Free Trial is available, it will be described on the purchase page.
3.2. Usage Limits:
Users with an active subscription are subject to usage limits.
SUBSCRIPTIONS AND CANCELLATION
4.1. Managing Subscriptions:
Subscriptions must be managed via the Play Store. Users can cancel their subscriptions through their Play Store.
4.2. Cancellation Policy:
If a user cancels their subscription, it will remain active until the end of the current billing cycle. No refunds will be provided for the remaining period.
4.3. Account Deletion:
Deleting an account is only possible if the user does not have an active subscription. Users must first cancel their subscription via the Play Store before requesting account deletion. To delete your account, contact us at [email protected] or delete on the app.
DATA SECURITY AND AVAILABILITY
5.1. Data Protection:
The NutriWiz Team works diligently to protect the security of user data and accounts. However, we cannot guarantee that our security measures will not be bypassed by third parties. Please inform our support team immediately of any suspected or actual violations or unauthorized access to your account.
5.2. Authentication:
NutriWiz uses a third-party authentication provider to manage account security. When a user creates an account, the provider assigns a unique identifier (ID) that NutriWiz uses to identify and manage the account securely. NutriWiz does not store user passwords or handle authentication directly, ensuring enhanced privacy and security.
5.3. Data Retention:
While NutriWiz retains data generated within the app to provide its services, we reserve the right to delete such data at any time without prior notice.
5.4. Service Availability:
NutriWiz strives to ensure the Services are available 24/7. However, we do not guarantee uninterrupted or error-free access and are not liable for any downtime or service interruptions.
WARRANTIES AND DISCLAIMERS
6.1. No Guarantee of Results:
NutriWiz does not guarantee specific results from using its Services, including dietary planning, meal analysis, and food nutrition evaluations. Users should verify all information provided by the platform and consult healthcare professionals before making dietary changes.
6.2. Informational Purposes Only:
NutriWiz’s Content and Features are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Users assume full responsibility for their use of the platform.
6.3. No Warranty:
The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
TERMINATION
7.1. Termination by NutriWiz:
NutriWiz reserves the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason
CHANGES TO THE TERMS OF USE
8.1. Right to Modify:
NutriWiz reserves the right to modify these Terms of Use at any time. Changes will take effect upon notification by email or through a prominent notice within the application.
8.2. User Acceptance:
Continued use of the application after such changes constitutes your acceptance of the modified Terms of Use.
THIRD-PARTY SERVICES
9.1. Integration with Third Parties:
NutriWiz may integrate with third-party services or platforms. Your use of these third-party services is subject to their respective terms and privacy policies. NutriWiz is not responsible for the practices or content of third-party services.
FEEDBACK AND SUGGESTIONS
16.1. User Feedback:
Users may provide feedback, suggestions, or ideas about the Services. By submitting feedback, you grant NutriWiz a non-exclusive, royalty-free, perpetual, and irrevocable license to use, modify, and distribute the feedback for any purpose without any obligation to you.

It does not matter what country, state, or region you come from; we are committed to providing you with individual privacy rights in accordance with the GDPR in relation to your personal data.
If you would like to exercise your right to request erasure of your account, you can visit the settings in your App.
We will address your request within one-month after receipt. It can take us up to 90 days in some cases, for example, for full erasure of your personal data stored in our backup systems. We will let you know if we need more time and explain the reasons for the delay.
We rely on your consent to process your health data to access the Services. You can withdraw this consent by contacting us or deleting your account in the App.
